1. Introduction and Who We Are
Welcome to Solar and Battery Leads (the “Platform”). The Platform is operated by [Entity Name], ABN [ABN Placeholder], a company registered in Victoria, Australia (“we”, “us”, or “our”).

2. What We Are (and What We Are Not)
Solar and Battery Leads is an online lead marketplace. We collect enquiries from homeowners and property owners (“Homeowners”) who are seeking quotes or information about solar panel and battery storage systems. We make those enquiries (“Leads”) available for purchase by solar and battery installation businesses (“Buyers”).
We are a marketplace intermediary only. We are not a solar or battery installer, we do not provide installation quotes, and we do not employ or contract installers. We facilitate the connection between Homeowners and Buyers but are not a party to any transaction or agreement between them.
We do not endorse any particular Buyer, installer, product, or service. The decision to engage with a Buyer rests entirely with the Homeowner, and vice versa.
3. Exclusive Leads
All Leads on the Platform are exclusive. This means:
- Each Lead is sold to exactly one Buyer.
- Once a Lead is purchased, it is immediately removed from the marketplace and is no longer available to any other Buyer.
- The purchasing Buyer gains permanent access to the full contact details for that Lead within their account dashboard.
We do not recycle, resell, or redistribute purchased Leads to other parties.
4. Accounts and Eligibility
4.1 Eligibility
The Platform is available to businesses only. By creating an account, you represent that:
- You are acting on behalf of a legally registered business entity operating in Australia.
- You have authority to bind that business to these Terms.
- Your business is engaged in the supply or installation of solar panels, battery storage systems, or related services.
- You are at least 18 years of age.
4.2 Accurate Information
You must provide accurate, complete, and up-to-date information when creating and maintaining your account. We may verify your business details and reserve the right to suspend or terminate accounts where information is found to be false or misleading.
4.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [Contact Email] if you suspect any unauthorised access to your account.
5. Credits and Payment
5.1 Credit System
Access to Leads is gated by a prepaid credit system. You purchase credits in advance and spend them to reveal the full contact details of a Lead.
5.2 Pricing and GST
All prices are displayed and charged in Australian Dollars (AUD) and are GST-inclusive unless otherwise stated. Payment is processed securely via Stripe. We do not store your card details on our servers.
5.3 Credit Expiry
Purchased credits expire [Credit Expiry Placeholder] from the date of purchase. Expired credits are forfeited and are not subject to refund.
5.4 Non-Refundable (Subject to Clause 8)
Credits are generally non-refundable. Refunds may be issued in limited circumstances as described in Section 8 (Refund Policy) below.
6. Lead Reveal and Contact Details
When you spend credits to purchase a Lead, the Platform reveals the full contact details associated with that enquiry. These details may include:
- The Homeowner's full name
- Phone number
- Email address
- Residential or property address
- Project notes and details submitted at the time of enquiry
Once contact details are revealed and credits are spent, the transaction is complete. The purchase cannot be reversed on the basis that you chose not to contact the Homeowner or that the Lead did not convert. Refer to Section 8 for the limited circumstances in which a refund may be considered.
7. Buyer Obligations and Data Handling
By purchasing a Lead, you become an independent data controller for the Homeowner's personal information disclosed to you. This means you bear full and independent legal responsibility for how you handle that information from the moment of disclosure.
7.1 Privacy and Data Laws
You must comply with all applicable laws when handling Lead data, including but not limited to:
- Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs)— including obligations around collection, use, disclosure, accuracy, security, and access.
- Spam Act 2003 (Cth) — you must not send unsolicited commercial electronic messages. All email or SMS communications must comply with consent, identification, and unsubscribe requirements.
- Do Not Call Register Act 2006 (Cth) — you must check the Do Not Call Register before making telemarketing or research calls to any number, unless an exemption applies.
- Any applicable state or territory legislation relating to privacy, consumer protection, or direct marketing.
7.2 Permitted Use of Lead Data
You may use the Homeowner's contact details only for the purpose of quoting, providing information about, or delivering solar panel and battery storage installation services.
You must not:
- Resell, share, transfer, or otherwise disclose Lead contact data to any third party.
- Use Lead data for any purpose unrelated to solar or battery installation services.
- Add Homeowner contact details to any bulk marketing list without the Homeowner's separate consent.
- Use Lead data to contact Homeowners about products or services that are unrelated to the original enquiry.
7.3 Professional Conduct
You agree to contact Homeowners in a professional, respectful, and timely manner. We may suspend or terminate your account if we receive credible complaints about harassing, misleading, or aggressive contact by you or your representatives.
8. Refund Policy
We understand that lead quality matters. Refunds or replacement credits for purchased Leads are issued at our sole discretion. We may issue a refund or credit replacement where:
- The Lead's contact details are demonstrably invalid — for example, a phone number that is permanently disconnected or an email address that is undeliverable (hard bounce); and
- The issue is reported to us within [Refund Window Placeholder] days of the Lead purchase date.
No refunds will be issued in the following circumstances:
- Change of mind after purchasing a Lead.
- A Homeowner who decides not to proceed with installation after you make contact.
- A Lead that does not convert to a sale or booking.
- You were unable to reach the Homeowner (i.e. no answer, voicemail, or unanswered email).
- The Lead does not match your preferred service area or project type.
- The credit expiry window has passed.
To request a refund or replacement credit, contact us at [Contact Email] with the Lead ID and a description of the issue.
9. Lead Quality and No Guarantees
Leads reflect genuine enquiries submitted by Homeowners at the time of submission. We take reasonable steps to validate contact details and filter obviously fraudulent or duplicate submissions.
However, we do not guarantee:
- Lead quality, lead intent, or the accuracy of information provided by the Homeowner.
- Conversion rates or that any Lead will result in a quote, sale, or installation.
- That a Homeowner's circumstances have not changed between the time of submission and your contact.
- That a Homeowner will be contactable or responsive.
Purchasing a Lead is an investment in an opportunity, not a guaranteed outcome.
10. Prohibited Conduct
You agree not to use the Platform to:
- Engage in spamming, harassment, or threatening communications with Homeowners or our team.
- Impersonate another business, person, or organisation.
- Resell, sublicense, or transfer your account or purchased Leads to third parties.
- Misuse Homeowner personal data in breach of the Privacy Act 1988 (Cth) or the APPs.
- Use automated tools, bots, scrapers, or scripts to access, extract, or copy Lead data.
- Attempt to reverse-engineer, decompile, or otherwise tamper with the Platform.
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
- Circumvent or attempt to circumvent any access control or security measure on the Platform.
We reserve the right to immediately suspend or terminate your account and to report conduct to relevant authorities in response to any violation of this section.
11. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, button icons, images, data compilations, software code, and the overall design and compilation of the Platform, is the property of [Entity Name] or its licensors and is protected by applicable Australian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for your legitimate business purposes under these Terms. No other rights are granted. You must not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without our prior written consent.
12. Limitation of Liability
To the maximum extent permitted by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and other applicable legislation:
- Our total liability to you for any claim arising out of or in connection with the Platform or these Terms is limited to the total amount of credits purchased by you in the 12 months immediately preceding the event giving rise to the claim.
- We exclude liability for any indirect, incidental, special, consequential, or punitive loss or damage, including loss of profit, loss of revenue, loss of business, or loss of data, even if we have been advised of the possibility of such losses.
- We do not exclude or limit liability where to do so would contravene the Australian Consumer Law or any other non-excludable consumer guarantee that applies to you by law.
Nothing in these Terms is intended to exclude any rights you may have as a consumer under non-excludable provisions of the Australian Consumer Law.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if:
- You breach any of these Terms.
- We have reasonable grounds to suspect fraudulent, abusive, or unlawful activity.
- We are required to do so by law or regulatory authority.
You may close your account at any time by contacting us. Upon termination, your access to the Platform will cease. Any unused credits at the time of termination for breach will be forfeited. We will consider refunds of unused credits where termination is at our initiative without cause on a case-by-case basis.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. You and we submit to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia sitting in Victoria.

15. Changes to These Terms
